Terms and Conditions

Here you will find Engadin St. Moritz Mountains’ Terms and Conditions for tickets, mountain railways, services, and other offerings. Please review the applicable terms and conditions for using our offerings and services.

1. General InformationThe General Terms and Conditions (GTC) apply to all services and products offered by Engadin St. Moritz Mountain Pool (ESMP). ESMP comprises the transportation facilities in the following snow sports and recreational areas:

  • Corvatsch/Furtschellas
  • Corviglia/Piz Nair
  • Diavolezza/Lagalb
  • Muottas Muragl
  • Zuoz
  • Pontresina/Languard
  • Samedan
  • La Punt
  • Maloja
  • S-chanf

 

2. Tickets and Season Tickets

2.1 ValidityAll tickets and season passes are personal and non-transferable. They are valid only during the published regular operating hours and for the booked period.

2.2 Loss or TheftIf a pass valid for 2 days or longer is lost or stolen, a replacement will be issued once upon presentation of the purchase receipt and a valid form of identification. A processing fee of CHF 15 will be charged for issuing the replacement pass.

2.3 Misuse and Counterfeiting

Tickets and passes that are used improperly or are counterfeit will be confiscated. Tickets and passes that are in use but are not valid for use may be revoked. The user must pay an administrative fee of CHF 150. We reserve the right to take civil or criminal action. 

2.4 Exchanges and Refunds in General

Tickets and passes cannot be exchanged for other tickets or passes after the fact. Generally, no refunds are available for single-day or multi-day tickets. For season/annual passes and flexible-day passes, refunds are granted exclusively in the event of illness or accident, but only upon presentation of a medical certificate covering the validity period of the pass. The medical certificate is generally the basis for calculating the refund amount. If the pass is used again at a later date, any entitlement to a refund is reduced to the date of the last use. Any claims for a refund must be submitted no later than 30 days after the occurrence of the event or before the expiration of the ticket or pass.

Customers are free to purchase appropriate insurance coverage from ESMP companies or third parties.

If operations are suspended due to inclement weather, force majeure (e.g., natural hazards), technical malfunctions, power outages (e.g., due to malfunctions, force majeure, or insufficient power supply), government-mandated energy-saving measures, safety concerns, or similar reasons, the customer is not entitled to a refund.

2.4.1 Exchanges and Refunds in Particular

If all ESMP transportation facilities are closed simultaneously (e.g., due to a mandatory government-ordered closure of all transportation facilities resulting from, for example, a pandemic or a power shortage), a refund or partial refund of the purchase price of tickets and season passes will be provided exclusively in the form of a voucher or by extending the validity period. A voucher may only be redeemed toward a future purchase of an ESMP ticket or season pass. Cash redemption is not permitted. The voucher is valid for 540 days (i.e., 1 ½ years) from the date of issuance.

The refund (partial refund) is calculated using the following formula:

Purchase price ÷ Validity period (in days) × Number of days of the government-mandated closure

No retroactive refunds will be issued for tickets or season passes if they were purchased after the closure mandated by the authorities. Likewise, no refunds will be issued for day passes or any tickets and season passes that are not sold to end customers in the ticket shop. Tickets and season passes do not need to be deposited and may continue to be used until the end of their validity period once the government-mandated closure has been lifted.

Refund claims must be filed no later than 30 days after the event occurs or before the ticket or subscription expires.

2.5 Price

The currently applicable pricing terms and the validity of tickets and passes are published at www.engadin.ch/de/berge.

2.6 Data Storage Media

The customer may be required to purchase, for a fee, a reusable electronic data carrier for contactless access to facilities and slopes. In return, the ESMP agrees to repurchase undamaged data carriers at any sales location at the same price within 72 hours after the expiration of the ticket or pass contained therein.

3. Exclusion from Transport

3.1 General

Passengers may be denied transportation if they: - are intoxicated or under the influence of narcotics;

- sich ungebührlich benehmen oder
- die Benützungs
- und Verhaltensvorschriften oder die darauf gestützten Anordnungen des Personals nicht befolgen.

In the event of a repeat offense or in serious cases, the ticket or pass may be revoked.

3.2 Transportation for the Purpose of Participating in a Sport

If weather conditions are unsuitable for participating in the sport—particularly in the event of an avalanche risk—individuals may be barred from transportation to the activity site.

Furthermore, individuals may be barred from transportation for the purpose of participating in a sport if, immediately prior to the intended transportation, they endanger third parties and there is reason to believe that they will continue to endanger third parties.

A risk to third parties exists, in particular, when the person in question:

- sich rücksichtslos verhalten hat;
- einen lawinengefährdeten Hang befahren hat;
- Weisungs- und Verbotstafeln, die der Sicherheit dienen, missachtet hat;
- sich den Sicherheitsanordnungen des Aufsichts- und des Rettungsdienstes widersetzt hat.

The above list is not exhaustive. The transport of sports and recreational equipment may be prohibited, particularly for technical reasons, safety considerations, or to comply with higher-level regulations. 

4. Photography and Videography

Please be advised that photographs and video recordings may be taken for the purposes of operational safety and access control.

5. Liability

To the extent permitted by law, the liability of ESMP and its affiliated companies is limited to cases of gross negligence and willful misconduct.

6. Emergency Medical Services

If a customer is involved in an accident within the ESMP area and emergency medical services must therefore be called, the customer will be billed for the resulting costs (personnel, materials, and third-party expenses). Third-party costs (e.g., Rega, doctor) must be paid directly by the customer. The customer must file any claims for reimbursement with their insurance company.

7. Liability for Failure to Comply with Orders

Freeriders and off-piste skiers who, in disregard of warning signs, ski on slopes at risk of avalanches and trigger avalanches are in breach of a contractual ancillary obligation and are liable to the ski lift operator for any resulting damage.

8. Data Protection

By purchasing a ticket and/or creating a customer profile or subscribing to a newsletter from one of the ESMP companies, the customer actively consents to the ESMP companies storing personal, sales, and usage data and reusing it for statistical and promotional purposes. Upon request, the customer has the right to view and correct the data stored in their profile and—provided such data is not strictly required by law or in accordance with the above provisions—to have it deleted. 

9. Final Provisions

With regard to the specific provisions concerning the “ENGADINcard 365”/“PIZcard 365” product, please refer to the General Terms and Conditions for “ENGADINcard 365 and PIZcard 365.” These constitute an integral part of these General Terms and Conditions. The contract between the customer and ESMP is governed exclusively by Swiss law. The exclusive place of jurisdiction is St. Moritz.

Terms and Conditions for the “ENGADINcard 365” and “PIZcard 365”

1. General Information

These General Terms and Conditions supplement the General Terms and Conditions (GTC) of the Engadin St. Moritz Mountain Pool (ESMP).

2. Purchase of the “ENGADINcard 365” or “PIZcard 365”

At a sales counter or online: The “ENGADINcard 365”/“PIZcard 365” can be purchased at a staffed sales counter or online. The contracting party must sign the Terms and Conditions for the “ENGADINcard 365”/“PIZcard 365” upon completion of the purchase. Online, the contract is concluded by accepting the Terms and Conditions.

3. Term of the Agreement and Termination

The contract takes effect upon signing or upon completion of the online purchase and is valid for an indefinite period. The validity period is 365 days. Unless otherwise expressly agreed, the validity period begins on the date the contract is concluded. The contract may be terminated at any time by providing one month’s notice prior to the expiration of the validity period of the “ENGADINcard 365”/“PIZcard 365.” Notice of termination must be provided in writing to the Engadin St. Moritz Mountain Pool.

If the “ENGADINcard 365”/“PIZcard 365” is not canceled, it is automatically renewed for an additional validity period of 365 days. A discounted rate is offered for this additional validity period (renewal discount). However, if the contract is canceled and then renewed at a later date, the entitlement to the discounted rate (renewal discount) expires.

Any other options for canceling or suspending the “ENGADINcard 365”/“PIZcard 365” are excluded, except as provided in Section 5 below. Refunds will be issued exclusively in accordance with the ESMP’s General Terms and Conditions.

The ESMP reserves the right to terminate the contract at any time for good cause.

4. Payment

Upon execution of the contract, the contracting party agrees to pay all amounts due in a timely manner. One month before the end of the validity period, the contract partner will be charged the invoice amount for the next validity period via the designated payment method or, failing that, will be billed. For a subsequent validity period, the invoice amount must be paid before the start of that period; otherwise, the contracting party will be in default without the need for a reminder.

The contracting party will be in default without a reminder if he or she fails to pay on time. If the contracting party is requested to pay via a reminder due to a late payment, CHF 15.00 will be charged. In the event of debt collection, additional collection fees may be charged. In any case, ESMP reserves the right to charge the applicable default interest in accordance with Art. 104 of the Swiss Code of Obligations (OR) as of the due date. ESMP reserves the right to assign its claims to third parties. If the contracting party is in default of payment to ESMP, ESMP may block the “ENGADINcard 365” / “PIZcard 365” at any time.

If the “ENGADINcard 365”/“PIZcard 365” is purchased through the online store, the specific payment terms of the respective payment processing partner apply.

5. Rate Changes

Prices and services are subject to change at any time. ESMP shall notify the contracting party in advance and in an appropriate manner of any changes to the rates. If the changes are disadvantageous to the contracting party, he or she may terminate the contract effective as of the date the change takes effect. If the contracting party fails to do so, they thereby accept the changes. Price changes become effective and binding upon the next billing cycle for the contracting party. The price of the “ENGADINcard 365”/“PIZcard 365” may change due to a transition to a higher age bracket. The rate applicable to the relevant age bracket on the first day of the respective validity period shall apply.
